1. Industrial Application, Installation & Safety

 

Professional Use Only: Our products are heavy-duty, industrial-grade fluid transfer systems designed for trained professionals. They utilize powerful electric motors, operate at high speeds, generate heat, and move heavy fluids under positive displacement pressure.

 

Bare Assemblies & Electrical Installation: Goldstream Pumps offers "Bare" pump and motor assemblies intended for custom integration. By purchasing a bare assembly, you acknowledge that you are responsible for supplying all safe and compliant wiring, switching, and mounting hardware. Goldstream Pumps assumes zero liability for equipment damage, fire, or injury resulting from improper electrical hardwiring or failure to comply with local electrical codes.

 

Safety Warning: You acknowledge that pumping industrial fluids involves inherent risks. By purchasing and operating our equipment, you accept full responsibility for ensuring that:

 
       
  • The pump and motor are properly and safely grounded.
  •    
  • The fluid being pumped is chemically compatible with the pump's materials (Cast Iron, Steel, Viton).
  •    
  • The pump is never used in explosive atmospheres, near open flames, or with highly flammable solvents (e.g., gasoline) unless the specific system is explosion-proof rated.
  •    
  • Operators utilize appropriate personal protective equipment (PPE) and follow standard industrial safety protocols.
  •  
 

2. Product Suitability & Fluid Compatibility

 

While we provide extensive guidance on motor specifications and fluid viscosity, the ultimate determination of equipment suitability for a specific environment is the sole responsibility of the buyer.

 
       
  • Viscosity & Environmental Variations: Fluid viscosity changes dramatically with temperature. A pump system configured for warm hydraulic fluid may overload its motor if used to pump freezing waste motor oil. We are not responsible for performance issues or motor failures caused by environmental temperature changes or unexpected fluid thickness.
  •    
  • Chemical Compatibility: Our standard cast-iron gear pumps are engineered strictly for petroleum and oil-based fluids. Use with water, acids, food products, or incompatible chemical solvents is strictly prohibited and immediately releases Goldstream Pumps from all liability.

3. Critical Limitation of Liability

To the fullest extent permitted by applicable law, Goldstream Pumps shall not be liable for any direct, indirect, punitive, or consequential damages arising from the use or inability to use our products. We explicitly disclaim liability for:

   
         
  • Consequential Damages: Loss of profits, facility downtime, business interruption, or loss of fluid inventory.
  •      
  • Incidental Damages: Cleanup costs, environmental remediation, or damage to surrounding infrastructure caused by pump failure, deadheading, or leaks.

  • Injury & Misuse: Personal injury resulting from improper installation, unauthorized modifications, lack of safety guards, or failure to follow standard industrial safety practices.
  •    

Under no circumstances shall our total liability for any claim arising out of or relating to our products exceed the original purchase price of the specific product that gave rise to the claim.

 
 

4. Warranty Reference

 

Your purchase is subject to our Limited 1-Year Warranty. This warranty is your exclusive remedy for defective goods. We disclaim all other warranties, express or implied, including warranties of merchantability or fitness for a particular non-industrial purpose.

 

5. Governing Law & Jurisdiction

 

These terms shall be governed by and construed in accordance with the laws of the State of South Carolina. Any legal action or proceeding relating to your access to the site or use of our products shall be instituted exclusively in a state or federal court located in Charleston County, South Carolina.
